Teamsters Pension Correction

In the Teamsters Road contract that went out in June 2018, there was a misprint on p. 16 under PENSION FUND. The contract reads as follows:

Effective: Daily Rate (paid on all days worked):
June 1, 2018 $67.00
June 1, 2019 *$68.70
*The Employer agrees to pay $68.70 per day for the duration of the contract.

The pension rate effective June 1, 2019 should be $68.40.
*Pension: Daily - $68.40, paid on all days worked.

MITA Agrees To Road Contract Extension Proposal From Laborers District Council

As road projects resume operations across the state following the September lockout of Operating Engineers, Local 324 (OE 324) employees, the Laborers District Council and MITA have agreed to extend their current contract, which originally went into effect on June 1, 2013. The agreed upon wage increases and overtime adjustments will go into effect on June 1, 2019 and will extend through May 31, 2025.

The MITA Labor Relations Division Committee felt that this extension proposal that was offered up by the Laborers District Council was very fair and equitable, as it will help signatory contractors to be more competitive in attracting a quality workforce, while at the same time offering consistency amongst the various trades. The overtime adjustment is the exact same language that is in the Carpenters and Cement Masons collective bargaining agreements for road construction, and this extension gives the industry an opportunity to plan six years ahead. The negotiation on this extension took less than two weeks to complete and includes no other language changes other than the overtime adjustment.

Wages will increase on June 1 of each year of the six-year contract by $1.00/hour in 2019, $2.00/hour in 2020, $2.00/hour in 2021, $2.00/hour in 2022, $1.00/hour in 2023 and $1.50/hour in 2024 for every wage classification. Any fringe benefit adjustment will be allocated from the negotiated increase first or will come off the base rate. The breakdown will be determined by the Union.

The overtime adjustment is as follows:

Article VIII, Section 1

1. HOURS OF WORK/OVERTIME – Where a single shift is worked, ten (10) hours of continuous employment, except for a one-half (1/2) hour unpaid lunch period, shall constitute a day’s work, beginning on Monday through Saturday of each week. Where work is performed in excess of ten (10) hours on any of those days, or in excess of 40 hours Monday through Sunday, time and a half (1 ½) the base wages shall be paid.

The mutual agreement on this contract extension means that MITA contractors and Michigan Laborers can now focus on what they do best, which is getting back to the important work of addressing Michigan’s massive unmet infrastructure needs.

MITA End of Lockout: Labor Dispute Continues - Guidance Bulletin #2

Although the lockout of the Operating Engineers, Local 324 (OE 324) ended on September 27, 2018, when the industry agreed to go back to work, project schedules are still experiencing delays due to the ongoing labor dispute with OE 324. MITA continues to communicate information about the disruptive tactics and actions of OE 324 to the Governor’s office and MDOT leadership, so that they are fully informed of and understand the challenges the MITA contractors are dealing with in maintaining our commitment to get back to work and demonstrate our best efforts to get projects completed or to a condition where they can be safely buttoned-up for the coming winter season.

This bulletin will give you guidance on how you should proceed on MDOT let projects as it relates to a Request for Time Extension associated with a delay due to the OE 324 labor dispute.

MDOT leadership has acknowledged that their prior responses to contractors’ notices of intent to file claim for a time extension and additional compensation¹ were unusual and premature as the Standard Specifications for Construction (Std. Specs.) do not require a written response to a simple “notice of intent” letter. MDOT explained that since they were responding to a few contractors who actually submitted a Request for Time Extension due to the labor dispute, they decided they would communicate the department’s position on extensions of time related to the labor dispute with all contractors, including those who had simply submitted a notice of intent letter.

Based on information that MITA has provided to the Governor’s office and MDOT leadership, MDOT leadership acknowledges that project schedule delays due to the OE 324 labor dispute are ongoing.

The following are the Std. Specs. contractual next steps (and anticipated MDOT responses) as we see them related to your submittal of a Request for Time Extension for project schedule delays due to the OE 324 labor dispute:

Step 1: Filing Your Request For Time Extension

The length of the delay to a project schedule must be evaluated and decided by the contractor on an individual project basis.

As the contractor, you must decide when the delay in your project schedule due to the labor dispute has ended.

When you have determined the end of the delay, per subsection 108.09.A of the Std. Specs., you have 14 calendar days after the last day of the delay to submit your request for time extension.

Be attentive to this 14 calendar day submittal timeframe.

Step 2: Engineer’s Response To Request For Time Extension

Per subsection 108.09.A of the Std. Specs., the Engineer has 14 calendar days from receipt of your request for time extension to provide you a written decision.

Based on conversations MITA has had with MDOT leadership, and responses we have already seen from submitted request for time extensions, we fully anticipate the Engineer’s response will include language detailing the following key points:

· Acknowledgement that your request has been reviewed

· A statement that based on current information the request/XX days is approved

· A statement that liquidated damages (LDs) will be assessed for the extension of time

· A statement that the assessment of LDs is subject to re-evaluation at final acceptance of the project

· A statement that they will consider all labor dispute claims and associated extension of time request claims to be timely filed if they are filed per subsection 104.10.D.2 of the Std. Specs. (i.e., within 60 days of final acceptance)

Step 3: Contractor’s Notice Of Intent To File Claim For Assessment Of LDs

Per subsection 108.09.A of the Std. Specs., the Contractor has 7 calendar days from receipt of the Engineers written decision to notify the Engineer in writing of the Contractor’s intent to file a claim related to any part of the Engineer’s decision on the request for extension of time.

Therefore, within 7 calendar days of your receipt of the Engineer’s decision on your request for time extension, you must submit your Notice of Intent to File Claim for the assessment of LDs on your approved extension of time.

Be attentive to this 7 calendar day notice submittal timeframe.

Step 4: Filing of a Claim for Assessment of LDs

Within 60 calendar days (or an agreed to extension of this timeframe) of the final acceptance of the project, you must submit your claim package disputing the Engineers assessment of LDs on your approved extension of time.

MITA believes that at some point in time, before any LDs are actually charged on any project delayed by the OE 324 labor dispute, MDOT will acknowledge that the industry’s defensive lockout was in fact a “labor dispute” within the context of subsection 108.08. We anticipate MDOT could then reverse their prior determination and thus conclude that delays due to the OE 324 labor dispute are “excusable delays” such that time extension can be granted without the assessment of LDs.

MITA continues to have conversations with MDOT leadership and legal counsel about the contract situations resulting from the OE 324 lockout, the ongoing labor dispute and the guidance given herein and will immediately notify all members of any changes and/or additions to our guidance.

¹MDOT’s denial of all notices of intent to claim additional compensation was not unexpected as we have acknowledged in prior bulletins that the MDOT Standard Specifications for Construction do not include “labor disputes” as a “compensable delay” in subsection 108.09.B, and that you should not anticipate you will receive additional compensation for costs incurred or related to a labor dispute delay. A contractor’s evaluation of valid claims for additional compensation can be made subsequent to a return to work and in accordance with subsection 104.10 of the Standard Specifications for Construction.

Addressing Employee Questions Regarding Their Employment Status & Notifying The Unemployment Agency

MITA has heard rumors that on or before 7:00 am on Tuesday, September 4, 2018, employees in the bargaining unit represented by OE 324 may approach their contractor employers asking about their status and/or claiming that they have been laid off.

If you receive such an inquiry, you should tell the worker that:

· The worker has been locked out as a part of a labor dispute with OE 324 effective Tuesday, September 4, 2018 at 7:00 am

· The reason for the defensive lockout is because of OE 324’s coercive tactics to disrupt work for other MITA contractors and the strike action against Ajax Paving, Inc.

· The worker has not been laid off

· The lockout will end when OE 324 ratifies the MITA statewide road agreement that MITA sent to OE 324 on August 29, 2018

· There currently is no statewide road agreement entered into between MITA and OE 324

· Employees will receive their remaining pay on the company’s next regularly scheduled pay date

Since issuing the lockout notice, MITA has received reports that some OE 324 employees have quit or walked off their job sites while work was in progress, apparently initiating a strike. It is important to highlight some strict NLRB rules that will play into the situation.

· It is important to differentiate between striking employees, lockout employees and employees who quit.

· Striking employees and lockout employees remain employees of your company. They are not treated as former employees; they are current employees. It is an unfair labor practice to treat a striking employee or lockout employee as a former employee. When the lockout is over, all contractors hope and expect that the striking/lockout employees will return to work.

· Employees who actually quit their jobs are no longer employees.

Therefore, it is mandatory for each contractor to determine when an employee quits whether that employee is actually giving up their job, OR prior to the lockout, engaging in a strike.

The Unemployment Insurance Agency (UIA) requires notice of a labor dispute within five days of its initiation.

· Therefore, if you have employees who have initiated a strike either on August 30 or 31, you must notify the UIA that a labor dispute started within five days of that strike action.

· If there is no strike action until the lockout on September 4th, then the notice of labor dispute to the UIA must be filed within five days of September 4 (September 11). We recommend that you get the notice of labor dispute in as quickly as possible to avoid any concern about missing the five-day limit.

WHAT HAPPENED AND WHY THINGS ARE BOUNCING BACK AND FORTH

Late last week, MITA took a dramatic shift in strategy when it notified Operating Engineers, Local 324 (OE 324) that it had rescinded the Power of Attorney (POA) for all companies working under the recently expired MITA Utility Distribution and Road Agreements. This decision came after significant thought and discussion with the MITA Labor Relations Committee. The goal was that by making this decision, all fringe checks would be accepted, cashed and credited by the Fringe Funds, thus relieving the significant sense of concern that the employees, who are caught in the middle during this contract stalemate, are feeling.

OE 324 had consistently said that it would not negotiate directly with MITA and would only accept and credit fringes from all non-MITA POA contractors, and so the decision was made to remove the obstacle that was supposedly MITA. There was hope that the union leadership would be true to its word and would begin to work with industry towards some sort of resolution.

However, at a special called meeting of the Operating Engineers (OE) Local 324 Fringe Funds Board of Trustees, a resolution was offered up by the union trustees and supported by two other management trustees to return all contributions received by the Fringe Funds to MITA POA contractors for all work hours following the expiration of the MITA Utility Distribution Agreement (May 1st) and the MITA Road Agreement (June 1st). Each MITA trustee and several other management trustees opposed the move, but were outvoted.

Early this week, several contractors began to receive their submitted contributions back from the OE 324 Fringe Fund Office, even though each of these contractors had all independently pulled their POA from MITA. In other words, OE 324 moved the goal posts and continues to attempt to manipulate the negotiations process.

PUT VACATION FRINGE PAY BACK INTO PAYCHECKS

Last week, MITA told you to reverse course and start sending in the Vacation fringe contribution with your August payment and to stop paying it directly to the employee. However, that is when we believed that the OE 324 Fringe Funds would now accept and credit all rescinded MITA POA contractor contributions. We are sorry for the confusion on this subject, butit is now suggested to include the Vacation fringe (Vacation and Supplemental Vacation) in the paycheck each week for all OE employees and to not put that amount into any qualified fringe benefit plan (as referenced below).

You should let your employees know that this fringe is now included in their paychecks and will continue until further notice. It is expected that any retroactivity of any fringe contributions, including the Vacation fringe, will be a significant point of any negotiations that might take place.

HEALTH CARE COVERAGE

The OE 324 continues to agree with MITA that all OE 324 employees should have access to their Hour Bank, their Medical Reimbursement Accounts and their Self-Payment Options. Therefore, during this contract stalemate, most, but not all employees should have access to continued healthcare coverage. The Vacation fringe payment, which is paid directly to the employees, will go a long way in helping to cover that burden. However, in no way should you, as an employer, in any way direct how any employee should spend their own money. If employees decide to use the extra money that is now in their paycheck to take advantage of the Self-Payment Option, that is their sole prerogative.

HOW TO HANDLE YOUR FRINGES NOW

If you are one of those contractors who have now received your fringe contributions back from the OE 324 Fringe Funds, you are likely concerned with how to handle your fringes at this point. Since you are working under an expired contract, there are a couple of options laid out below for you.

For all Utility Distribution Contractors and for those Road Contractors who are working on private projects or on state/locally funded projects, where no prevailing wage requirements apply, the answer and solution is simple. The suggestion for these companies is to simply put all of the fringes for each month (including those that were returned) into a segregated escrow account (separate from your other corporate funds) until some sort of resolution is reached.

For all other Road Contractors working on federally funded projects, your primary employer obligation is to be compliant with the federal Davis-Bacon prevailing wage law, therefore, the answer and solution is a little more challenging.

The suggestion is for each company to now pay a base wage that includes the Vacation & Holiday fringe ($4.19) and Supplemental Vacation ($0.05) for a total Area 1/Group 1 operating engineer rate of $32.21 per hour. If you are working in different areas of the state and/or are classifying employees in different groups, the same concept applies, but may include different rates.

For the balance of the prevailing wage package, fringes must now be credited to the employee in order to be compliant with Davis-Bacon. The suggested manner for accomplishing this is for each company to deposit the balance owed to the employee (Area 1/Group 1 operating engineer is $23.30 per hour) into a company 401(k) plan (or similar qualified fringe benefit plan). By following this strategy and adding it to the “base wage plus vacation” referenced above, you will satisfy the current prevailing wage total package requirement.

Again, since you are working under an expired contract, you have no obligation to include the Labor Management Education Committee contribution ($0.16) in the monies deposited in your company 401(k) plan (or a qualified fringe benefit plan) for your OE 324 employees. The Industry Advancement Fund (IAF) ($0.12) can be paid directly to MITA with the attached form(s) on a monthly basis from now on and should not be considered part of your prevailing wage payment.

We do acknowledge and understand that some contractors may have a small number of OE 324 employees who may be without health care because they haven’t accumulated sufficient work hours (520 hours) to earn an hour bank, nor are they eligible to make self-payments to the OE 324 Healthcare Fund. For these employees it is acceptable under the Davis Bacon law for the company to pay the premium for a separate health care plan. To compute the company’s allowable hourly cost for this health care plan for credit toward meeting the prevailing wage obligation, you divide the total annual cost for that health care plan by the total number of hours the OE 324 employee works in a year (including work on both federal Davis-Bacon prevailing wage covered and non-covered work). When you have computed this allowable hourly health care plan cost you can deduct it from the hourly amount you are depositing into a company 401(k) (or a qualified fringe benefit plan) to satisfy the prevailing wage total package requirement.

MITA continues to work on and search for qualified alternative fringe benefit plans so that companies might have other viable options in how they satisfy the federal Davis-Bacon prevailing wage requirements. Please stay tuned, as MITA will be forwarding these other options out to the industry in future bulletins.

It is MITA’s understanding that companies may receive a letter from MDOT indicating that they have reason to believe there may be a prevailing wage compliance situation as it relates to the payment of fringe benefits to operating engineer employees. MDOT’s intended purpose with this letter is to put the company on notice of a potential situation and request that the company respond and/or rectify the cited situation in a given period of time (typically 30 days). Although MDOT’s past practice has been that the letter does not immediately assess penalties to the company, MDOT does have the authority to withhold future payments for the company’s failure to respond and/or rectify the cited situation. It is MITA’s hope that a company who receives this letter could rectify a cited operating engineer fringe benefit non-payment claim during this 30-day time period by making the fringe benefit payments into a qualified fringe benefit plan as described above.

Therefore, to summarize the information presented above, no company is required to rush into a “qualified plan solution” because of the 30-day flexibility, which does not even start until your receipt of a letter from MDOT, so take your time and find the right plan to fit your company’s needs. Secondly, keep in mind that if your company (Road) fits into both categories of Davis-Bacon and non-prevailing wage work, you can use a mix of the options listed above by using the escrow concept along with a qualified plan. And lastly, by being patient, other options may become available to you once MITA is able to bring those ideas to bear.

THREATS AND COERCION BY OE 324 REPRESENTATIVES

We have received numerous reports that employees have been threatened and/or coerced by OE 324 representatives with the loss of pension and healthcare benefits. If this has happened, it is a violation of the National Labor Relations Act. We are prepared to investigate these threats and pursue them with the National Labor Relations Board. In order to do that, we need to have employees come forward to be interviewed about what they know about these threats. These interviews are completely voluntary. The employees must know that their answers to the questions will not affect their job; that there will be no reprisals; and that they can terminate the interview at any time. You can interview employees as long as you follow the instructions in the Attached Guidance Document. This document is specifically for employee information gathering and should be used if you feel that any of your employees have been threatened or coerced.

WITHDRAWAL LIABILITY INFORMATION REQUEST

Legal counsel has suggested that all contractors who have received the Withdrawal Liability Information Request, from the OE 324 Fringe Funds, should respond to OE 324 with the following statement at this point:

Be advised that this Company continues to have an obligation to contribute to the Local 324 Pension Fund. This company is a Contributing Employer under Section 1.4 of the Pension Plan, which defines a “Contributing Employer” as “any other Employer engaged in work coming within the jurisdiction of the Union which contributes to the Trust Fund or which is obligated by … any other written agreement to make contributions to the Trust Fund.…”

In addition, we are also subject to the “labor dispute” exemption of ERISA.

For all other Road Contractors working on federally funded projects, your primary employer obligation is to be compliant with the federal Davis-Bacon prevailing wage law, therefore, the answer and solution is a little more challenging.

The suggestion is for each company to now pay a base wage that includes the Vacation & Holiday fringe ($4.19) and Supplemental Vacation ($0.05) for a total Area 1/Group 1 operating engineer rate of $32.21 per hour. If you are working in different areas of the state and/or are classifying employees in different groups, the same concept applies, but may include different rates.

For the balance of the prevailing wage package, fringes must now be credited to the employee in order to be compliant with Davis-Bacon. The suggested manner for accomplishing this is for each company to deposit the balance owed to the employee (Area 1/Group 1 operating engineer is $23.30 per hour) into a company 401(k) plan (or similar qualified fringe benefit plan). By following this strategy and adding it to the “base wage plus vacation” referenced above, you will satisfy the current prevailing wage total package requirement.

Again, since you are working under an expired contract, you have no obligation to include the Labor Management Education Committee contribution ($0.16) in the monies deposited in your company 401(k) plan (or a qualified fringe benefit plan) for your OE 324 employees. The Industry Advancement Fund (IAF) ($0.12) can be paid directly to MITA with the attached form(s) on a monthly basis from now on and should not be considered part of your prevailing wage payment.

We do acknowledge and understand that some contractors may have a small number of OE 324 employees who may be without health care because they haven’t accumulated sufficient work hours (520 hours) to earn an hour bank, nor are they eligible to make self-payments to the OE 324 Healthcare Fund. For these employees it is acceptable under the Davis Bacon law for the company to pay the premium for a separate health care plan. To compute the company’s allowable hourly cost for this health care plan for credit toward meeting the prevailing wage obligation, you divide the total annual cost for that health care plan by the total number of hours the OE 324 employee works in a year (including work on both federal Davis-Bacon prevailing wage covered and non-covered work). When you have computed this allowable hourly health care plan cost you can deduct it from the hourly amount you are depositing into a company 401(k) (or a qualified fringe benefit plan) to satisfy the prevailing wage total package requirement.

MITA continues to work on and search for qualified alternative fringe benefit plans so that companies might have other viable options in how they satisfy the federal Davis-Bacon prevailing wage requirements. Please stay tuned, as MITA will be forwarding these other options out to the industry in future bulletins.

It is MITA’s understanding that companies may receive a letter from MDOT indicating that they have reason to believe there may be a prevailing wage compliance situation as it relates to the payment of fringe benefits to operating engineer employees. MDOT’s intended purpose with this letter is to put the company on notice of a potential situation and request that the company respond and/or rectify the cited situation in a given period of time (typically 30 days). Although MDOT’s past practice has been that the letter does not immediately assess penalties to the company, MDOT does have the authority to withhold future payments for the company’s failure to respond and/or rectify the cited situation. It is MITA’s hope that a company who receives this letter could rectify a cited operating engineer fringe benefit non-payment claim during this 30-day time period by making the fringe benefit payments into a qualified fringe benefit plan as described above.

Therefore, to summarize the information presented above, no company is required to rush into a “qualified plan solution” because of the 30-day flexibility, which does not even start until your receipt of a letter from MDOT, so take your time and find the right plan to fit your company’s needs. Secondly, keep in mind that if your company (Road) fits into both categories of Davis-Bacon and non-prevailing wage work, you can use a mix of the options listed above by using the escrow concept along with a qualified plan. And lastly, by being patient, other options may become available to you once MITA is able to bring those ideas to bear.

THREATS AND COERCION BY OE 324 REPRESENTATIVES

We have received numerous reports that employees have been threatened and/or coerced by OE 324 representatives with the loss of pension and healthcare benefits. If this has happened, it is a violation of the National Labor Relations Act. We are prepared to investigate these threats and pursue them with the National Labor Relations Board. In order to do that, we need to have employees come forward to be interviewed about what they know about these threats. These interviews are completely voluntary. The employees must know that their answers to the questions will not affect their job; that there will be no reprisals; and that they can terminate the interview at any time. You can interview employees as long as you follow the instructions in the Attached Guidance Document. This document is specifically for employee information gathering and should be used if you feel that any of your employees have been threatened or coerced.

WITHDRAWAL LIABILITY INFORMATION REQUEST

Legal counsel has suggested that all contractors who have received the Withdrawal Liability Information Request, from the OE 324 Fringe Funds, should respond to OE 324 with the following statement at this point:

Be advised that this Company continues to have an obligation to contribute to the Local 324 Pension Fund. This company is a Contributing Employer under Section 1.4 of the Pension Plan, which defines a “Contributing Employer” as “any other Employer engaged in work coming within the jurisdiction of the Union which contributes to the Trust Fund or which is obligated by … any other written agreement to make contributions to the Trust Fund.…”

In addition, we are also subject to the “labor dispute” exemption of ERISA.

MITA RESCINDS POWER OF ATTORNEY FOR OE 324

As of Wednesday, August 8th, 2018, MITA has notified Operating Engineers, Local 324 that it has rescinded Power of Attorney for all companies working under the recently expired MITA Road and MITA Utility Distribution Agreements. This decision is one that was made with significant thought and discussion with the entire MITA Labor Relations Committee.

Ultimately, this dramatic shift in strategy was chosen as the best course of action for all companies involved in this contract stalemate. More importantly, this decision was executed to relieve the significant sense of concern that the employees, who are stuck in the middle by working under these agreements, are feeling. By making this decision, all fringe benefits checks should now be accepted, cashed and credited to the employees during contract talks.

There will be a group of contractors reaching out to each one of you to discuss potential negotiations with OE 324. If the union contacts you directly, or if your company is feeling coerced in any way, please feel free to contact the MITA office.

FRINGE FUNDS, APPRENTICES AND EXTRA HELP

Throughout this struggle with OE 324, the union leadership has regularly stated that the only reason that they were not willing to accept fringe benefit funds, to supply certification on apprentices and to send extra help when requested by a contractor, was because of the Power of Attorney relationship that those affected contractors had with MITA. Now that the rescission has happened, it is expected that the OE 324 leadership will be true to its word and those rejections should no longer happen.

AUGUST 15TH FRINGE CONTRIBUTIONS

At this point, it is suggested that all fringe contributions be made as they were prior to the expiration of your respective agreement. This means that you should immediately stop including the vacation fringe contributions in the weekly paychecks of all Operating Engineers, and send the full month’s worth of contributions in with your fringe check on August 15th.

PENSION WITHDRAWAL LIABILITY QUESTIONNAIRE

From the very beginning of this process with OE 324, it was recognized that the union leadership would try to exploit contractor concerns over withdrawal liability. MITA staff and legal counsel have worked diligently to prepare any and all arguments that pension withdrawal liability cannot and should not be triggered in any way during this labor dispute.

Recently, the OE 324 Pension Plan announced that it will be performing an information gathering process, and therefore you may soon be receiving a form from the Pension Plan asking for corporate information. A copy of the form is attached. This form is not a withdrawal liability notice, and there should be no concern that somehow withdrawal liability is now going to soon be triggered. It is only a request for basic information.

However, it is important that this form be filled out correctly and returned in a timely manner to the OE 324 Pension Plan. Because it is important to have the correct information on the form, MITA is scheduling a meeting (see below) with our attorney, Don Scharg, to go over how to properly complete the form.

MITA LRD Cmte. Response To OE 324 Claim That Multi-Employer Association Contract Is Being Negotiated

On July 23, 2018, MITA received a letter (SEE ATTACHED) from Douglas Stockwell, Business Manager of Operating Engineers, Local 324 (OE 324).

Contrary to what the letter claims, MITA has NOT been informing any persons or entities, including its membership, that OE 324 is negotiating a multi-employer association contract with MITA.

The MITA Labor Relations Committee, which is comprised of executives from several signatory union construction companies, has reached out to OE 324 several times in an effort to begin negotiating for a new collective bargaining agreement. To date, however, the union has refused to meet.

The MITA Labor Relations Committee includes the following individuals:

Pending Letter From Operating Engineers, Local 324 Fringe Funds

This bulletin only applies to contractors who have signed power of attorney to MITA for Road and Utility Distribution construction. If you are an independent union contractor, you will have received a separate mailing and will be working under a separate set of rules that will not affect your fringe benefit payments, as directed in this bulletin.

As a signatory contractor, you may be receiving a letter (ATTACHED HERE) this week or next regarding the acceptance and crediting of fringes. This letter is a follow-up to the MITA request that all fringe benefits be accepted by Operating Engineers, Local 324 (OE 324) and credited while contract talks are at a standstill. At this point, OE 324 representatives have rejected all MITA efforts to allow employees working under the Road and Utility Distribution Agreements to be credited with the fringes that are being sent in, and thus, the checks are being accepted and held (not cashed) by OE 324.

As MITA has suggested before, your company should continue to send in your monthly fringe benefit payments on time until further notice is given. It should also be noted that all fringes for ROAD AND UTILITY DISTRIBUTION WORK should be sent in via hard copy check through regular mail. All other fringes (for underground or other types of OE 324 work) will continue to be accepted and credited as usual.

Another issue that is addressed in the letter is the payment of the Vacation and Holiday fringe. Because this fringe is taxed to the employee prior to being sent into the OE 324 fringe funds, it is considered wages for the employee, based on the various payments of wage laws at the state and federal level. Therefore, at this time, it is suggested that all Vacation & Holiday Fund contributions (15% funded) be withheld from your monthly fringe contribution check and instead be included in the weekly paycheck of all OE 324 employees working under the Road and Utility Distribution Agreements.

So, to be clear, each company working under the MITA Road or Utility Distribution (OE 324) Agreements should do the following:

* If you have not sent in your OE fringe contribution check for June, remove all Vacation & Holiday contributions and send contributions only for Pension, Healthcare, Defined Contribution, Retiree Benefit, Labor Management Education Committee and Journeymen, Apprentice Training and Industry Advancement Fund via certified mail with the attached cover letter (SAMPLE LETTER - A).

* If you have already sent your fringe contribution for June (and for May if you are contributing as a signatory MITA Utility Distribution contractor), send a new check as described in the bullet point above, along with a cover letter (SAMPLE LETTER - B) via certified mail requesting that the earlier check be returned and replaced with the updated fringe contribution.

* Once you have sent your contributions and letters into the fringe funds, use the sample letter (SAMPLE LETTER - C) to communicate with your OE 324 employees and cut a retroactive check for the Vacation & Holiday fringe to those employees back to June 1 for Road employees or back to May 1 for Utility Distribution employees. Then, continue to include the Vacation & Holiday contributions (15%) in the weekly wages of each OE employee until further notice.

These payments will obviously need to be tracked very carefully, as they will need to be recognized in any future contract discussions and will also need to be easily recognized in any audit that may take place in the future.

Operating Engineers, Local 324 Letter

Over the course of the last few days, most contractors have received a letter (or two) in the mail from Operating Engineers, Local 324 (OE 324) regarding their refusal to negotiate with any contractor who has given MITA Power Of Attorney (POA). This letter is addressed to Finkel Whitefield Selik, which is the law firm that is legal counsel for the OE 324 Fringe Benefit Funds.

This letter was sent on June 18th in response to MITA’s request that all fringe benefit contributions be accepted and credited during this negotiations stalemate (our request was voted down by the union trustees and thus, all fringes are being accepted and held, but not credited to the employees). THIS LETTER WAS SENT TO YOU AS NOTHING MORE THAN A SCARE TACTIC ATTEMPT BY OE 324. There is nothing that you need to do with the letter, and no response is required.

MITA staff continues to look at every angle of every strategy in order to find a resolution to this unfortunate situation.

Update on Operating Engineers, Local 324 (Be Wary of Union Authored Contracts)

Operating Engineers, Local 324 (OE 324) continues to refuse to meet with MITA, even though the MITA/OE Utility Distribution Agreement has been expired since May 1, 2018, and the MITA/OE Road Agreement has been expired since June 1, 2018. By all accounts, business continues as usual; however, there are many moving parts in play that should be considered.

Over the last few days, several contractors have received a “new” Road Contract in the mail with a request from OE 324 “to please sign and return the enclosed agreement”. THIS IS NOT A NEGOTIATED AGREEMENT AND SHOULD NOT BE SIGNED AND RETURNED! This is an attempt by OE 324 to confuse the industry with a simple signature request on a labor contract that has been written solely by and for the union. If you received one of these bogus contracts in the mail (or even if a Business Agent has dropped one off), you should be very wary.

The “new union-authored contract” includes several new items that will change the way that you do business with the union. First of all, a hiring hall is included now in a short one-sentence paragraph, which ties into a multi-page policy that the union has not bothered to provide. Also, the union has slipped in several new classifications, which in turn have premiums built-in, which ultimately significantly increases the seemingly minimal economic increases being offered by the union.

OE 324, through their Business Agents, is telling contractors that they will not send any referrals to contractors if they are with MITA. They are also telling some folks that they will not sign up any new hires into the union for this same reason. At this point, since the industry is working without a contract, you have no responsibility to sign up new hires into the union. It is recommended that all contractors pay the proper scale for all operators and also send monthly contributions into the fringe funds for ALL operators performing work under the old contract, including new hires, even if they are not a signed member of the union.

It has been confirmed that the OE 324 fringe benefits funds will continue to accept and hold all contribution checks that come in for the Utility Distribution and Road Agreements, so it is recommended that all signatory contractors continue to send in the fringes like normal at the 2017 effective rates. However, to be clear, these checks will be “held only”, and no crediting will take place for any employees currently working under these expired agreements at this time. If your company submits contributions electronically, you may receive a request to submit a mailed check instead for the time being.

Finally, one of the biggest concerns of every employer is continued coverage of benefits for all employees. All operators who have accrued the minimum of three months (520 hours) of healthcare eligibility prior to the termination of a MITA/OE collective bargaining agreement will continue to have healthcare coverage for the next three months. This means that operators working under the Utility Agreement will have coverage through the end of July and operators working under the Road Agreement will have coverage through the end of August. Any new hires who were on the job for less than the minimum three months will not develop eligibility until a new contract is executed.

Negotiations At A Standstill With Operating Engineers Local 324 (Road Agreement)

The MITA Road Negotiations Committee has, over the last month, reached out to the Operating Engineers, Local 324 (OE 324) several times in an effort to begin bargaining for a new collective bargaining agreement. To date, the union has refused to meet and has informed the committee that it is withdrawing from any multi-employer bargaining with MITA.

Obviously, this strategy by OE 324 makes little sense and has forced MITA to take several tactical steps in order to prepare for the potential of a drawn out labor struggle. With significant legal guidance, MITA has put into place a website, which will be used to share facts and information with ALL of your affected employees. This website will house a list of the contractors so employees understand the scope of the impact. It will include a Frequently Asked Questions section, as well as other informational components. The site will also include proposals that the committee has offered to the union in an attempt to open discussions.

You are encouraged to share the attached letter with ALL of your employees (all trades, not just OE 324) so they can get all of the latest facts. It is at times like this, during a standstill in contract talks, that many unsubstantiated rumors begin to circulate. As an employer, you are allowed to share this letter with employees as often as possible through paycheck stuffers, regular mail, email and even company Facebook pages.

Let us warn you to be very careful when communicating with employees. All communications are controlled by NLRB rules. Common sense statements are not always considered legal by the NLRB. It is important that you stick to the direction we provide. It is also VERY important that you do not attempt to negotiate directly with your employees in any way. Nor should you attempt to pressure them. Just share the website and encourage them to get the true facts there.

Classifications and Wage Rates

* All employees performing Open Cut Construction work shall be classified in accordance with the following classifications:

Class I: Construction Laborer.

Class II: Mortar and material mixers, concrete form man, signal man, well point man, manhole, headwall and catch basin builder, guard rail builders, headwall, seawall, breakwall, dock builder and fence erector .

Class III: Air, gasoline and electric tool operator, vibrator operator, drillers, pump man, tar kettle operator, bracers, rodder, reinforced steel or mesh man (e.g., wire mesh, steel mats, dowel bars, etc.) cement finisher, welder, pipe jacking and boring man, wagon drill and air track operator and concrete saw operator (under 40 hp), windlass and tugger man and directional boring man.

Class IV: Trench or excavating grade man.

Class V: Pipe layer (including crock, metal pipe, multi-plate or other conduits).

Class VI: Grouting man, top man assistant, audio-visual television operations and all other operations in connection with closed circuit television inspection, pipe cleaning and pipe relining work and the installation and repair of water service pipe and appurtenances.
Class VII: Restoration Laborer, seeding, sodding, planting, cutting, mulching and topsoil grading and the restoration of property such as replacing mail boxes, wood chips, planter boxes, flagstones, etc.

(b) An inexperienced laborer is defined as an individual who has not worked for a period of 120 calendar days under this Agreement or the immediately preceding Agreement between the Michigan Infrastructure & Transportation Association and the Michigan Laborers District Council.

(d) the inexperienced laborers’ rate will be as follows:

First 3 months - 65% of Class I rate
Second 3 months - 75% of Class I rate
Third 3 months - 85% of Class I rate
After 9 months - 100% of applicable rate

Michigan Conference of Teamsters Welfare Fund (MCTWF) Coverage

RE: Michigan Conference of Teamsters Welfare Fund (MCTWF) Coverage

As part of the recently negotiated collective bargaining agreement with the Teamsters, an “Opt-Out” provision was included, which allows for a Teamster to opt-out of the MCTWF and the savings on the weekly contribution will be split 50% to the employer and 50% to the employee (to be included in the weekly paycheck).

The Michigan Conference of Teamsters Welfare Fund is required by the IRS to send the attached Memorandum of Understanding to each employer, confirming that the employer and the local union have agreed to an addendum to their collective bargaining agreement allowing bargaining unit employees to opt out of the MCTWF coverage.

If an employee seeks to opt out of the MCTWF they must submit a fully completed and executed Participation Opt Out Application for Employee and Family so that it is received by the MCTWF by the applicable dates listed in the Memorandum.

If you plan to take advantage of this “Opt-Out” provision with any Teamster that you may employ, you must sign the attached Memorandum of Understanding and also submit the date (current plan year) of your Section 125 compliant cafeteria plan.

Road Table Agreement Reached between MITA and the Michigan Teamsters Joint Council 43

RE: Road Table Agreement Reached between MITA and the Michigan Teamsters Joint Council 43

MITA has been successful in the negotiation of a five (5) year Road Agreement with the Michigan Teamsters Joint Council 43 (click here to view the Table Agreement). The economics of this settlement amount to an average annual increase of approximately 2% per year on the total package over the life of the agreement. Once approved this new agreement will go into effect by June 1, 2013.

The following Fringe Benefits became effective April 1, 2013:

Underground Construction:

Counties of: Wayne, Oakland, Macomb, Washtenaw, Monroe, St. Clair, Genesee, Shiawassee and Lapeer.

Wage rates will remain the same, no changes.

Health & Welfare - $358.65 per week

Pension - $55.00 per day with maximum of $275.00 per week

Aggregate Agreement:

Wage Adjustment per classifications – Effective April 1, 2013:

Tri Axles (Tandems) - .25¢ / hour increase

Semis - .25¢ / hour increase

Trains – .25¢ / hour increase

Fuel Truck/Low Boy – .25¢ / hour increase

Health & Welfare – Employer to pay the premium of Health & Welfare coverage for the employee and eligible dependents at no charge to the employee.

Pension - $20.90 per day up to a maximum of $104.50 per week.
