Detroit Executive Order Update

Through the Executive Order Working Group, industry leaders continue to meet with representatives of the City of Detroit Mayor’s Office to pursue the creation of administrative guidelines for implementation of Executive Order 2007-1.

Issued by Mayor Kilpatrick last September, the Executive Order (EO) states that all City of Detroit construction contracts shall have at least fifty-one percent of the workforce be bona-fide Detroit residents, and that workforce shall perform fifty-one percent of the hours worked on said projects.  The EO applies to all construction projects funded, in whole or in part, by the City, and it was scheduled to take effect on November 1, 2007.

Although the EO continues to be included in RFPs and City departments are telling contractors that they must comply with it’s requirements, the Mayor’s General Counsel, Sharon McPhail, has pledged that the City would not enforce the EO until the administrative guidelines have been defined.  To-date those administrative guidelines remain undefined, and therefore the requirements of the EO are not being enforced. 

MITA remains opposed to this “local hiring” ordinance as well as others that have been proposed by cities around the state.
