MDOT to Implement New DBE Liquid AC Dealer Monitoring Procedures

Effective with the projects let in the December 4, 2009, bid letting, the Michigan Department of Transportation (MDOT) will implement new monitoring procedures for the DBE supply and delivery of liquid asphalt.  These new monitoring procedures were developed and are being implemented in response to Federal Highway Administration concerns regarding the performance of a commercially useful function by the DBE liquid asphalt regular dealers.


The criteria that must be met that would allow a prime contractor to include DBE liquid asphalt regular dealer (work classification TBR) participation toward a project goal are detailed in MDOT’s Bureau of Highway Instructional Memorandum 2009-09: Disadvantaged Business Enterprise (DBE) Participation as Regular Dealers of Liquid Asphalt.


The new monitoring procedures require participation by both the prime contractors and the DBE’s who maintain the TBR (Asphalt and Petroleum Products – Regular Dealer) work classification. Prime contractors who choose to use DBE liquid asphalt regular dealer participation toward a project goal will be required to complete the new MDOT Form 0193, Disadvantaged Business Enterprise (DBE) Regular Dealer Liquid Asphalt Supplier Participation Affidavit – Prime, in addition to the standard “Blue Sheet”, MDOT Form 0178, Disadvantaged Business Enterprise (DBE) Participation.  For the purposes of monitoring supplier activities on those projects, the DBE liquid asphalt regular dealer is required to complete the new MDOT Form 0194, Total Quantities of Liquid Asphalt Cement Supplied.


As a part of their annual submittal, DBE’s wishing to maintain the TBR work classification will be required to provide information about their accounts with refineries using the new MDOT Form 0192, Petroleum Company Account(s) Information and Liquid Asphalt Cement Tractors and Trailers Information.


The procedures for using and accounting for only the trucking of liquid asphalt cement by a certified DBE toward a project goal are not changed or affected by these new regular dealer monitoring procedures.
